Still the season to be wary
With the recent changes in the building and construction industry, the 2018 industry shutdown is a time to be particularly wary.
The Building and Construction Industry Payments Act 2004 has been repealed.
The Subcontractors’ Charges Act 1974 has been repealed.
Chapters 3 and 4 of the Building Industry Fairness (Security of Payment) Act 2017 (‘the BIF Act’) have commenced … at last!
The period 22 December 2018 to 10 January 2019 is now the BIF freeze zone … because those days are not business days pursuant to the BIF Act.
That does not mean that the various time lines pursuant to your contract do not run, because your contract may impose quite separate obligations to the obligations imposed by the BIF Act.
If you are having a well earned break or going away, you need to be sure that someone is keeping an eye on your business whilst you are away … reading your emails and receiving and opening and reading your mail.
