BCIPA Freeze!

Changes to the Building and Construction Industry Payments Act 2004 (BCIPA) in July 2015 mean that the ‘BCIPA freeze’ that used to end on 1 January, is now extended to 10 January.

Those changes to BCIPA changed the definition of ‘business day’ to not include:-

  • a Saturday or a Sunday;
  • a public holiday in the place in which the relevant Act is to be or maybe done; or
  • any day occurring within any of the following periods:-
    • 22-24 December;
    • 27-31 December; or
    • 2-10 January.

So, the entire period from 22 December until 10 January will not be used when calculating deadlines under BCIPA.

But beware … that does not mean that other processes have a similar holiday.

BCIPA is one of the few processes that counts its days as business days.  For most other processes, the calendar days between now and when you return to work, will be counted.

With the traditional industry shutdown now upon us, you need to ensure that someone is keeping an eye on your business whilst you are away … to read your emails and open your mail.
